Agreement and Waiver of Liability for TECFIT Program.What is the TECFIT fitness program and how does it work?
TECFIT or Technology Fitness, also known as Whole Body Electro Muscle Stimulation (WB-EMS) is a type of electrical muscle stimulation that uses a suit that delivers electrical impulses to the entire body.
The electrical impulses are designed to mimic the signals that the nervous system sends to muscles during physical exercise, causing the muscles to contract and relax. The idea behind WB-EMS is that it can provide a more efficient workout than traditional exercise, leading to faster and more significant improvements in strength, endurance, and overall fitness.Some key terms to understand when it comes to WB-EMS include:
Electrical Muscle Stimulation (EMS): A type of therapy that uses electrical impulses to stimulate the muscles.
Muscle contractions: The tightening and relaxing of muscles that occurs during physical activity.
Intensity: The strength of the electrical impulses delivered by the EMS device, which can be adjusted to provide a more or less intense workout.
Frequency: The number of electrical impulses delivered per second, which can also be adjusted to provide a more or less intense workout.
Benefits of WB-EMS include:
Improved muscle strength and endurance: The electrical impulses delivered by WB-EMS can cause muscle fibers to contract more strongly than they would during traditional exercise, leading to improved muscle strength and endurance.
Time-saving: WB-EMS workouts can be shorter than traditional exercise sessions, making it a time-efficient way to improve fitness.
Reduced joint stress: Since WB-EMS does not require weights or other equipment, it can be a good option for people who want to exercise without putting stress on their joints.
Risks and limitations of WB-EMS include:
Overuse injuries: As with any form of exercise, overuse injuries are a risk with WB-EMS. It is important to follow proper form and not overdo it with the intensity or frequency of the electrical impulses.
Not a replacement for traditional exercise: While WB-EMS can be a useful addition to a workout routine, it should not be seen as a replacement for traditional exercise. It is still important to engage in physical activity that includes aerobic exercise and resistance training.
As a condition of my membership in the TECFIT program and use of its facilities, equipment, services and activities, I acknowledge and agree to the following:Physical Examination: Technology Fitness LLC or any commercial partner, representative, employee, trainer, manager, associate, and any other representing the company or TECFIT brand (TECFIT) urges all members to obtain a physical examination from their physicians prior to initiating any exercise program. TECFIT training programs are not designed for individuals with known heart pacemakers, pregnancy, cancer, acute injury or disease, or central nervous system disorders with or without functional impairment. The TECFIT program is contraindicated, for the aforementioned conditions.
Assumption of Risk: I acknowledge, understand, and appreciate that my entry upon and/or use of the TECFIT program through the list of facilities, equipment, services, and activities of or offered by the TECFIT Parties entails significant risks, both known and unknown, including, without limitation, the possibility of physical or emotional injury, paralysis, death, other serious or catastrophic personal injuries, and loss or damage to personal property.
Waiver and Release: I knowingly and voluntarily waive any cause of action of any kind whatsoever arising as a result of my participation in such activity from which any liability may or could accrue to TECFIT officers, affiliates, agents, employees, instructors, or assigns, and agree to hold TECFIT officers, affiliates, agents, employees, instructors, or assigns harmless therefrom.
Assumption of All Risks: I expressly agree and promise to accept and assume all of the risks, both known and unknown, that may arise as a result of my entry upon, participation in, and use of TECFIT program through the list of facilities, equipment, services, and activities of or offered by TECFIT Parties, whether such risks are caused or alleged to be caused by the negligent acts or omissions of any TECFIT Parties, and that as a member, I am voluntarily entering upon, participating in, and using the facilities, equipment, services, and activities of or offered by TECFIT Parties, and that I am electing to take such voluntary actions in spite of the risks. I acknowledge and agree that I am solely responsible for my safety and responsible entry upon, participating in, and use of the facilities, equipment, services, and activities of or offered by TECFIT Parties, whether or not supervised by a TECFIT Party.
Release and Discharge: I expressly and voluntarily release and forever discharge each of the TECFIT Facilities and Parties from any and all claims, demands, causes of action, or liability for any loss, damages, injuries, or death that I may suffer as a result of my entry upon, participation in or use of the facilities, equipment, services, or activities of or offered by the TECFIT Parties, whether the same arises out of or results from any act, omission, or conduct of one or more of the TECFIT Parties, negligent or otherwise.
Indemnification: I expressly agree to hold harmless, indemnify, and defend each of the TECFIT Parties [with attorneys of each TECFIT Party’s choice] from any and all claims, demands, causes of action, or liability for any loss, damages, injuries, or death suffered by any other person in connection with my entry upon, participation in or use of the facilities, equipment, services or activities of or offered by TECFIT Parties, whether the same arises out of or results from any act, omission, or conduct of one or more of the TECFIT Parties, negligent or otherwise. The agreement by me to hold harmless, indemnify and defend the TECFIT Parties is immediate upon the assertion of any claims, demands, causes of action or liability by any other person, is not contingent or dependent upon a finding that my actions caused loss, damages, injuries, or death claimed. The agreement by me to hold harmless, indemnify, and defend the TECFIT Parties includes all consequential damages incurred by the TECFIT Parties, or which otherwise would be incurred by the TECFIT Parties absent the agreement, including, but not limited to, all attorney’s fees and costs, court and litigation costs, experts' fees and costs, arbitrator fees and costs, mediator fees and costs, payment of any judgment, verdict, award, or settlement on behalf of the TECFIT Parties, and any other damages incurred by the TECFIT Parties not included in the preceding list, which arise as a direct or indirect consequence of the claims, demands, causes of action, or liability asserted by any other person.
I acknowledge that I have carefully read this Agreement and Waiver of Liability, fully understand its contents, and sign it voluntarily and without coercion. I represent that I am at least 18 years of age, or that I have the consent of my parent(s) or legal guardian to enter into this Agreement and Waiver of Liability.
